Hardship Exceptions: Protecting Assets in Medicaid Estate Recovery

For many MVLS clients, the home is the single largest asset that they have, and it is imperative that it pass on to the next generation. However, in the event the client receives Medicaid benefits, there is the possibility that Medicaid will attempt to seek recovery for the payment of these benefits by placing a lien on the recipient’s home or failing a claim against the recipient’s estate – thereby removing the home from the family.
